These Terms and Conditions ("Agreement") govern your access to and use of the CareSignals platform and services. By accessing or using CareSignals, you agree to be bound by these terms. If you do not agree to these terms, you may not use the service.
1. Service Description
CareSignals is a HIPAA-compliant patient satisfaction survey platform designed for home health agencies. The service enables agencies to:
- • Send automated SMS surveys to patients after home health visits
- • Collect visit-level patient satisfaction feedback and ratings
- • Provide clinicians with individual performance dashboards
- • Generate aggregated reports for agency leadership
- • Track trends and identify coaching opportunities
CareSignals is provided "as-is" and is intended for use by licensed home health agencies only.
2. SMS Messaging Terms
Patient Consent
Your agency is responsible for obtaining explicit written or verbal consent from patients before CareSignals sends them SMS survey messages. Consent must comply with HIPAA requirements and your jurisdiction's regulations. You must inform patients of the frequency and purpose of surveys before enrollment.
Message Frequency
Survey SMS messages are sent after each home health visit for enrolled patients. Patients will receive approximately one survey per visit. Frequency may vary based on visit schedules and patient enrollment patterns.
Opting Out
Patients may opt out of SMS surveys at any time by replying STOP to any survey message. They will not receive further survey messages after opting out. Your agency will be notified when a patient has opted out.
Note: Opting out of CareSignals surveys does not affect a patient's receipt of other communications from your agency.
Message Rates & Charges
Standard SMS rates apply to survey messages sent and received. Message and data rates may apply depending on your mobile carrier. Patients should contact their carrier with questions about SMS charges.
3. User Accounts and Responsibilities
Account Creation
To use CareSignals, your agency must create an account. You must provide accurate, current, and complete information during registration. You are responsible for keeping your account information up to date.
User Credentials
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not share login credentials with unauthorized individuals. If you suspect unauthorized access, you must notify us immediately.
Authorized Use Only
You agree to use CareSignals only for lawful purposes and in accordance with these terms. You must not use the platform to:
- • Access or collect data on patients who have not consented
- • Violate HIPAA or other privacy regulations
- • Interfere with platform security or functionality
- • Use the platform for any purpose other than home health operations
4. HIPAA Compliance Commitment
CareSignals is designed and operated in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and HIPAA Security Rule requirements. We maintain appropriate administrative, physical, and technical safeguards to protect patient health information.
Before using CareSignals to collect patient health information, your agency must:
- • Execute a Business Associate Agreement (BAA) with CareSignals
- • Ensure your HIPAA Privacy and Security Policies permit this use
- • Train staff on proper handling of patient data within the platform
Your agency remains responsible for HIPAA compliance in your operations and must ensure that your use of CareSignals aligns with your privacy practices and policies.
5. Data Handling and Security
Data Ownership
Your agency retains ownership of all patient data collected and stored within CareSignals. CareSignals acts as a processor of this data on your behalf.
Encryption & Protection
All patient health information is encrypted using AES-256-GCM encryption with per-tenant key management. Data is transmitted securely using TLS 1.2 or higher. Access is controlled through role-based access controls and row-level security.
Data Access & Retention
Patient data is retained for 7 years in accordance with HIPAA standards and CMS documentation requirements. After 7 years, patient-identifiable information is securely deleted. Your agency may request data deletion at any time by contacting us.
No Resale or Sharing
CareSignals does not sell, trade, or share patient health information with third parties for marketing or commercial purposes. Aggregated, de-identified data may be used to improve the platform.
6. Limitation of Liability
To the fullest extent permitted by law, CareSignals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of revenue, loss of data, or business interruption.
CareSignals' total liability for any claim shall not exceed the amounts paid by your agency to CareSignals in the 12 months preceding the claim.
7. Disclaimers
AS-IS BASIS: CareSignals is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure.
CLINICAL DISCLAIMER: CareSignals is a survey platform and does not provide medical advice or clinical guidance. Patient feedback should be used to supplement, not replace, clinical judgment and professional oversight.
8. Termination
CareSignals may terminate your account at any time if you violate these terms, fail to pay subscription fees, or breach HIPAA requirements. You may cancel your account at any time by contacting us.
Upon termination, your access to the platform will be disabled. You may request a data export within 30 days of termination. After 30 days, all your data will be securely deleted in accordance with our data retention policy.
9. Changes to Terms
CareSignals may update these Terms and Conditions from time to time. Material changes will be communicated to you via email and the "Last updated" date at the top of this page will be revised. Your continued use of the platform after such updates constitutes your acceptance of the revised terms.
